Summary:
Under Chapter 39 of the Eighth Session of the New York State Legislature, passed in 1785, land that was held under one title by joint tenants, tenants in common, or coparceners coonly be divided or partitioned by commissioners appointed by the Court of Common Pleas. Three commissioners wereappointed by the court to divide the land equally among the joint tenants. These records consist of proceeding returns the Court of Common Pleas dating from 1790 until 1850.

Overview


These records consist of proceeding returns of the Court of Common Pleas. The returns include a summary of proceedings; notices of publication; notice to the surveyor general; oaths of the commissioners; abstracts of deeds, surveys and maps; and often a table of errors. Also included are ballot books used to record the drawing of ballots fo the partition of lands. The majority of these records relate to lands in the Hardenburgh and Hurley Patentee Woods.


Biographical Sketch


Under Chapter 39 of the Eighth Session of the New York State Legislature, passed in 1785, land that was held under one title by joint tenants, tenants in common, or coparceners could only be divided or partitioned by commissioners appointed by the Court of Common Pleas. Normally, this occurred afte the death of one of the joint tenants. Joint tenants petitioned the court to have the land divided. Notice the partition was required to appear in two newspapers. Three commissioners were appointed by the court to divide the land equally among the joint tenants. A section of the jointly held land, known as an expense lot, was set aside as payment for the commissioners. Ballots were drawn for the divided land parcel out the land among the tenants. Commissioners surveyed the lands held in common and divide each parcel equally. They were required to submit a return of partition, which included a summary of proceedings and surveys to the County Clerk’s office. In 1875, the Ulster County Board of Supervisors appointed Daniel T. Van Buren to preserve the maps in the County Clerk’s office. At this time, lan partition records were gathered together, removed from their original bindings and placed, unbound, in book covers. Also at this time, some maps were removed from the textual records and placed on wood rollers. Since that time, the maps had been removed from the rollers and affixed to pages in large boo presently housed at the County Clerk’s office.
